1Agreeing to these terms
These terms are an agreement between you and PLAYTONIQ GAMES LIMITED about Across the Pond (the "App"). Installing or using the App means you accept them. If you do not accept them, delete the App.
You must be at least 13 years old to use the App. If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf.
2What the App does
Across the Pond is a quiz game about the differences between British and American English. It includes daily challenges, quick play, category challenges, story mode, duels against other players, leaderboards, and a seasonal battle pass. Some features need an internet connection.
Quiz content is for entertainment. Language changes, regional usage varies, and we make no claim that every answer settles the matter.
3Your account
You can play as a guest or sign in with Apple, Google or email. Guest progress lives on your device only — uninstall the App and it is gone. Sign in to back it up.
Keep your sign-in credentials to yourself. You are responsible for what happens on your account. Tell us at playtoniqgames@gmail.com if you think someone else is using it.
One person, one account. Do not create accounts to farm rewards, manipulate leaderboards, or evade a suspension.
4How you may use the App
Do not:
- Use the App for anything unlawful.
- Reverse engineer, decompile or disassemble the App, except where the law says you may.
- Use bots, modified clients, memory editors or exploits to change scores, currency or entitlements.
- Harass, threaten or abuse other players through duels, challenges or display names.
- Impersonate anyone, or pick a display name that is offensive, misleading or infringing.
- Interfere with our servers, scrape our content, or resell access to the App.
We may remove content, reset progress obtained by cheating, or suspend accounts that break these rules.
5Purchases and subscriptions
The App is free to play and offers optional purchases:
- Dual Citizen Pass — an auto-renewing subscription, monthly or annual, unlocking premium features.
- Remove Ads — a one-time purchase.
- Hint packs and streak freezes — consumable items.
- Premium battle pass — a one-time purchase for the current season.
Apple and Google process every payment and charge the account you bought with. Prices are shown in your local currency before you confirm, and may vary by region and over time.
Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends. Manage or cancel a subscription in your App Store or Google Play account settings — deleting the App does not cancel it. Where a free trial is offered, any unused part of it ends when you buy a subscription.
Consumable items are used up when you spend them and cannot be restored. Restoring purchases brings back subscriptions and one-time purchases only.
Refunds are handled by Apple and Google under their own policies. Ask them directly; we cannot refund a store purchase for you. Nothing here affects statutory rights you cannot waive.
Quid and Buck are in-game currency. They have no cash value, cannot be exchanged for money or transferred between accounts, and may be discontinued with reasonable notice.
6Your content
Display names, avatar choices and anything else you submit stay yours. By submitting them you give us a worldwide, non-exclusive, royalty-free license to host and display them inside the App — on leaderboards, in duels and in challenge invitations — for as long as your account exists.
You are responsible for what you submit. We may remove anything that breaks section 4.
7Our content
The App and everything in it — questions, explanations, artwork, logos, sound, code and game design — belong to PLAYTONIQ GAMES LIMITED or our licensors, and are protected by copyright and trademark law.
We grant you a personal, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial enjoyment. You may not copy, distribute, modify or publicly display any part of it without our written permission.
8Availability and changes
We add, change and remove features as the game develops. We may take the App or its online features offline for maintenance, or discontinue them altogether. If we discontinue a feature you have paid for, we will offer a fair remedy such as a pro-rata refund of the unused subscription period.
9Disclaimers
The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
We do not promise the App will be uninterrupted, error-free, or that leaderboards and duel results will always be accurate.
10Limitation of liability
To the fullest extent the law allows, PLAYTONIQ GAMES LIMITED is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or opportunity, arising from your use of the App.
Our total liability for all claims relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 50.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
11Ending your access
You can leave at any time: delete your account under Settings › Account › Delete my account, or simply uninstall the App. Deleting your account removes your data as described in the Privacy Policy.
We may suspend or end your access if you break these terms, or if we stop operating the App. Where the reason is not urgent we will give you notice first.
Sections that are meant to outlast the agreement do — including content licenses already granted, disclaimers, liability limits and dispute resolution.
12Apple and Google
This agreement is between you and us, not with Apple or Google. They are not responsible for the App or its content, and have no obligation to provide support or handle claims about it.
Apple and its subsidiaries are third-party beneficiaries of these terms for the iOS version, and may enforce them against you. Support questions go to playtoniqgames@gmail.com, not to Apple or Google.
13Governing law and disputes
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.
Talk to us first. Email playtoniqgames@gmail.com with the details and we will try to sort it out within 30 days before either side starts formal proceedings.
14Changes to these terms
We may update these terms. When we do we change the date at the top, and for significant changes we tell you in the App. Carrying on playing after a change means you accept the new terms; if you do not, stop using the App and delete your account.
